Around 5th November, many constituents contact me concerned about the anti social use of fireworks. Their misuse causes nuisance, upset and frequent injury to children, the elderly and animals.
In October 2004, new laws were brought in to control the supply, possession and use of fireworks. These regulations make it illegal to let off fireworks between 11pm and 7 am with the exception of Hogmanay, Chinese New Year, Diwali and Bonfire Night. However, even here there’s a curfew. On 5th November fireworks must stop at midnight and on Hogmanay, Chinese New Year and Diwali by 1am. Anyone breaking the curfew is liable to face a fine of up to £5000 or could face up to 6 months in prison.
It’s illegal for under 18s to purchase or possess fireworks in a public place. Retailers can only sell fireworks for three weeks before 5 November and five days after without a full licence granted by the local licensing authority. Other regulations limit the noise levels of fireworks to 120 decibels.
I want these laws to be as effective as possible and ask local people to report to the police fireworks set off after 11pm, sales to under 18s or their anti-social use. The laws will lead to the reduction of fireworks misuse across Edinburgh South West and a safer more enjoyable evening which respects the vulnerable in our community.
